General Terms and Conditions of Business
The general terms and conditions of the online store Brodi.si are prepared in accordance with the Consumer Protection Act (ZVPot-1) and the Personal Data Protection Act (ZVOP-1). The general terms and conditions regulate the operation of the online store, the rights of the user, and the business relationship between the provider and the buyer.
Provider
The online sales of Brodi are carried out by the company Brodi, Marko Brodar s.p., Za Mošenikom 9, 4290 Tržič, info@brodi.si (hereinafter: the provider). The company is registered in the Business Register of Slovenia, registration number 5256563000. The date of registration is 9.3.1994.
The company is liable for VAT (VAT ID: SI29862647).
Tax number: 292862647.
The company Brodi, Marko Brodar s.p. operates in accordance with the Electronic Commerce Market Act (ZEPT) and regulations adopted on its basis.
Prices
All prices are in euros (EUR) and already include VAT (9.5% or 22%), unless explicitly stated otherwise. The price listed next to each product does not include delivery costs.
The provider reserves the right to change prices without prior notice.
The prices and other benefits (discounts, gifts, delivery method, shipping participation, etc.) valid at the time and hour of placing the order apply. The original invoice you receive upon payment or delivery applies, in connection with the general terms and conditions published on this page and confirmed when placing the order.
Discounts, promotional codes, and similar do not accumulate.
A strikethrough price is the previous price of the product in the online store brodi.si, namely the lowest price applied by the seller during the period not longer than 30 days before the reduced price was applied.
Gift Vouchers
You can order a gift voucher in the online store or by e-mail at info@brodi.si. The same rules apply for both versions of the Brodi gift voucher, electronic and paper. Both can be redeemed when purchasing in the online store or at our physical store.
The code on the voucher is unique and enables a one-time redemption in the online store www.brodi.si or at Brodi retail outlets.
The voucher cannot be exchanged for cash. If the product is worth less than the value of the voucher, the difference will be returned to you as a new voucher, but only in increments of 10. You can pay the difference up to the full voucher value.
Example: you purchased goods worth €44.00. You have a voucher worth €50.00. You redeem the voucher, pay €4, and thus receive a new voucher worth €10.
When ordering a gift voucher, you select the type of voucher. An electronic gift voucher will be sent to you in electronic form by e-mail. A paper gift voucher will be sent by post to the delivery address. You can order several vouchers of different values at once.
In addition to the type of gift voucher, when ordering you also enter the name of the giver, the name of the recipient, and a dedication. All this information is printed on the voucher itself.
The gift voucher is not valid for payment of delivery costs and payment transaction costs.
The validity of the gift voucher is 2 years from the date of issue.
Payment Methods
The provider offers the following payment methods:

prepayment (pro forma invoice),

payment with Maestro, VISA, or Mastercard payment cards,

payment with a credit card via the PayPal system,
-
cash payment upon personal pickup.
Contract
The purchase contract (order) is concluded in Slovenian. It is stored in the information system at the provider’s headquarters and is available to the buyer every working day between 9 a.m. and 1 p.m., except during holiday closure of the Tržič office. Upon placing the order, the buyer receives confirmation of the order and a copy of the contract in electronic form to the e-mail address provided.
Delivery
The provider will deliver the goods within the agreed period to the delivery address. When the goods are dispatched, we will notify you by e-mail and with a short SMS to your mobile phone, if you entered it when placing the order.
The contractual partner for the delivery of shipments is Pošta Slovenije, but the provider reserves the right to choose another delivery service if this allows the order to be fulfilled more efficiently. All shipments are insured in case of damage or loss.
The ordered goods can also be personally collected at our store Za Mošenikom 9 in Tržič.
Right of Withdrawal from Purchase, Return of Goods
The consumer has the right to notify the company within 14 days of receipt of the goods that they are withdrawing from the contract, without having to state a reason. The period begins to run one day after the date of receipt. The only cost borne by the consumer in connection with the withdrawal is the direct cost of returning the goods. The goods must be returned to the company no later than 14 days from the notice of withdrawal.
The consumer does not have the right to withdraw from the contract when purchasing products that are made according to their precise instructions, customized to their personal needs, or which by their nature are not suitable for return.
Such products include custom-made slippers, including:

added motif or name, color change,
-
narrowed or widened models to order, other shape adjustments,
-
changes such as additional rubber or a replaced sole made of another material, color change,
-
other customizations agreed with the customer.
As these are products made according to the individual specifications of the customer, return or exchange after the order is completed is not possible.
Nonconformity of Goods
We strive to always provide you with quality and safe products. However, it may happen that a product does not meet expectations or legally prescribed requirements.
A product is considered nonconforming when:
-
it does not have properties necessary for normal use or for sale,
-
it is not suitable for a specific use for which the buyer purchased it, if such purpose was known to the seller at purchase,
-
it does not have the characteristics or features that were agreed upon or presented,
-
it does not match the sample or model on which it was purchased,
-
it was delivered incomplete or with a defect that affects its functionality.
Liability of the Seller
The seller is liable for any nonconformity of goods that exists at the time of delivery and appears within two years of delivery. If the nonconformity appears within one year of delivery, it is presumed to have already existed at the time of delivery, unless the seller proves otherwise.
If the subject of the contract is used goods, the seller and the buyer may agree on a shorter liability period, but not shorter than one year.
The seller is not liable for nonconformity if the buyer was specifically informed about a particular feature of the goods before the conclusion of the contract, which deviates from the requirements for conformity, and the buyer expressly agreed to this.
Consumer Rights
In the event of nonconformity, the consumer has the right to:

request free restoration of conformity of the goods (repair or replacement),
-
request a price reduction proportional to the nonconformity of the product,
-
withdraw from the contract and request a refund of the amount paid.
Procedure for Asserting Nonconformity
The consumer must notify the seller of the nonconformity within two months from the day it was discovered and attach the invoice or other proof of purchase at Brodi.
Form for return of nonconforming goods:

Fill out the form for return of nonconforming goods,

bring the item to the headquarters of Brodi, Marko Brodar s.p., or
-
send the item by post to the company headquarters. Do not forget to attach the form for asserting nonconformity of the product.

The product must be adequately protected before shipping to avoid possible damage during transport.
How is suitability of the item checked?
It is checked against another flawless item of the same type. The manufacturer is obliged to perform the check/repair within 30 days of receiving the goods (the period may be extended by 15 additional days if more time is needed for the repair), otherwise the product must be replaced with another equivalent and flawless product. If the item is no longer available, a refund will follow.
Product Display
Products in the online store www.brodi.si are presented with descriptions, photographs, and, where possible, additional presentation materials. The photographs and descriptions are prepared to show as accurately as possible the actual appearance, color, shape, and other characteristics of the products.
Nevertheless, minor deviations may occur:

due to screen settings and lighting during photography, color shades may differ from the actual product,
-
with natural materials (leather, fur, cork, etc.) natural deviations in structure, color, or pattern are possible, which are a characteristic and advantage of these materials,
-
with handmade products, minimal deviations in seams, details, or pattern placement are possible, as these are unique handmade items.
These deviations do not constitute nonconformity of the goods, but are a natural result of handmade production and the use of natural materials.
Security
Shopping in the Brodi online store is completely safe. We have ensured this with the most modern measures to protect your confidential data.
All your confidential data that you enter for the purpose of making a purchase or registration, and that is transmitted over the Internet, is properly encrypted so that it cannot be read by any third party. For this purpose, the online store uses SSL (Secure Socket Layer) technology and a 256-bit encryption key.
User Registration
An individual may also log in as a registered user in the Brodi.si online store. The contents of the online store are also accessible to anonymous unregistered users (guests). Registered users provide the required data during the registration process. Each registered user receives their own username and password, which is secret. The user must ensure that their username and password are used exclusively by themselves or by a person authorized by them. Each user is independently responsible for the content they enter on Brodi.si. The final buyer in the online store Brodi.si is exclusively the registered user or unregistered user (guest) who buys goods for personal purposes or non-profit activities. On the Brodi.si website, the buyer is exclusively a natural person.
If a user registers, the company Brodi, Marko Brodar s.p. will use the entered data until cancellation for processing the user’s order, preparing more relevant offers, and for marketing analyses to help improve the sales process. The data may also be used for remarketing. Registration also makes it easier for the user to track past purchases and shortens the purchase process. The company Brodi, Marko Brodar s.p. keeps the data until cancellation or deregistration in accordance with Slovenian legislation. The user may cancel at any time by sending an e-mail to info@brodi.si or by clicking the Delete account button. If the user wishes to delete the account, the e-mail must contain the following information: the subject must be “Cancellation of user account”; the content must state the user’s name and surname, address, and e-mail address with which the user registered; the e-mail must be sent from the address with which the user is registered.
Shopping as a Guest
If the user places an order as a guest, the company Brodi, Marko Brodar s.p. will use the entered data to process the order. As a VAT taxpayer, Brodi, Marko Brodar s.p. must, in accordance with Article 86 of the VAT Act, ensure the storage of invoices relating to the supply of goods or services in Slovenia for at least 10 years after the end of the year to which the invoices relate – thus the data contained in the invoice is also stored.
Contact forms and e-mails
The user can send specific questions to Brodi, Marko Brodar s.p. via contact forms or e-mails published on the website, and in doing so entrusts the provided data to the controller. This data will be used to resolve the user’s question. The e-mails listed on the website are not personal but business e-mails. Therefore, they are not tied to one natural person, but data submitted in this way may be processed by various persons for the purpose of quick and efficient resolution of the user’s inquiry. By sending an e-mail via the online form or to the addresses listed on this website, the user agrees to the general terms of use of the Brodi.si website.
Protection of Personal Data
We are aware that the privacy of visitors to our online store is very important. Therefore, we guarantee 100% protection of your personal data in accordance with the Personal Data Protection Act.
All personal data will be kept confidential and will not be shared with anyone without your prior consent. Only your delivery address will be provided to the delivery service.
By concluding the purchase contract, you agree that your data will be stored and used for the purposes of internal archiving and statistics, as well as communication for the execution of the order.
For security purposes, IP addresses from which users access the online store are also collected. At the beginning of the visit, each user is assigned a session cookie for identification and shopping cart tracking.
The registered user is also responsible for protecting personal data by ensuring the security of their username and password.

Complaints and Disputes
The provider respects the applicable consumer protection legislation. The provider makes every effort to fulfill its obligation to establish an efficient complaint handling system and to designate a person with whom the customer can contact by phone or e-mail in case of problems. Complaints are submitted via e-mail: info@brodi.si. The complaint handling process is confidential.
The provider will confirm receipt of the complaint within five working days, inform the customer how long it will take to process it, and keep the customer informed about the progress of the procedure.
The provider is aware that a key characteristic of consumer disputes, at least regarding court proceedings, is the disproportion between the economic value of the claim and the costs arising from the dispute itself. This is also the main reason why the consumer does not initiate proceedings before the court. Therefore, the provider strives to resolve possible disputes amicably to the best of its ability.
Out-of-Court Resolution of Consumer Disputes
In accordance with legal norms, Brodi, Marko Brodar s.p. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving a consumer dispute that the consumer could initiate under the Out-of-Court Resolution of Consumer Disputes Act.
Brodi, Marko Brodar s.p., which as a provider of goods and services enables online trading in Slovenia, publishes on its website an electronic link to the platform for online resolution of consumer disputes (SRPS). This arrangement derives from the Out-of-Court Resolution of Consumer Disputes Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
